The Big Picture

Why This Is Actually Exciting

Malaysia just leveled up. For years, the rules for handling customer data were fuzzy. Now they're clear. For years, AI was the wild west. Now there's a map. That clarity is your unfair advantage. While competitors are using AI or collecting data the wrong way, you can do both — correctly, confidently, and with a stamp that customers trust.

PDPA Got Teeth
As of June 2025, you must have a Data Protection Officer if you're serious (20,000+ customers, or 10,000+ sensitive records like financial or health data), and you have 72 hours to report a serious data breach. Fines are now up to RM1 million.
AI Got a Compass
Government released National Guidelines on AI Governance & Ethics (AIGE) in Sept 2024. It's voluntary, but Bank Negara is already using it to judge you. Seven principles: Be fair, be safe, protect privacy, be inclusive, be transparent, be accountable, and actually help people.
The Triple Check
In April 2026, three new rules dropped — you now need a DPIA (Data Protection Impact Assessment) before you use AI to decide who gets a loan, what insurance costs, or how an estate is split.
Translation: If you build the right system now, you're future-proof.
Part 1: Your PII Playbook

The Data You Hold is Gold

If you touch IC numbers, bank statements, medical reports, or even just names + phone numbers for a loan or insurance deal — you are a "Data Controller". That word changed from "Data User" in April 2025 to match global standards.

A) The 7 Non-Negotiables

Tell them upfront: What you collect, why, who you share it with, how long you keep it. In BM and English.
Get real consent: No pre-ticked boxes. Record it. Sensitive needs EXPLICIT consent.
Don't overshare: Only use data for reason collected. Home loan ≠ insurance list.
Lock it down: Law for you AND vendors. Encryption, access controls.
Don't hoard it: When deal done + retention over, delete permanently.
Keep it true: Fix wrong data.
Let them see it: If customer asks "what do you have on me?", show them.

B) Your Action Triggers

Hit 20,000 customers? Or 10,000 with financial/health data? You MUST appoint a DPO, register within 21 days, put contact on website. Had a breach? If could cause serious harm or affects >1,000 people, 72 hours to Commissioner and 7 days to customer if high risk. Sending data overseas? (US CRM like GHL, SG cloud) Need extra due diligence under Cross-Border rules.
